Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Im Zuge des Planungsfortschrittes ist erkannt worden, dass das Gewerk KT für die Stellwerksauflassung einiger Stellwerke, BSHs

statt Außenverteilerschränke benötigt. Daher müssen jetzt Planungen für vier BSHs erfolgen.

Außerdem war in den Rückbauplanungen für die EP, das BSH der Gleiswaage im Gl. 32o nicht berücksichtigt. Der Rückbau des

BSHs der Gleiswaage muss aber erfolgen und daher auch in die Rückbauplanungen integriert werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Um der TK-Technik, wegen den zukünftigen Stellwerksauflassungen, den notwendigen Platz zu bieten, muss nun mit BSHs

statt Außenverteilerschränke geplant werden. Die Notwendigkeit ergibt sich aus dem Platzbedarf. Gleichzeitig wurde der Rückbau

des BSHs der Gleiswaage nicht in die Rückbaukonzeption integriert.

Bei einem Auftragnehmerwechsel für die Teilleistungen, entstehen Schnittstellen zu anschließenden Planungen. Um eine

funktionierende Schnittstelle sicher zu stellen, müssen Planer der angrenzenden Bereiche, zuarbeiten und in Teilen damit die

Planugen des neuen Planers mitbearbeiten. Dadurch entsteht eine Dopplung der planerischen Arbeiten, als auch entsprechenden

Mehrkosten. Wegen dem geringen Aufwand und dem soeben dargestellte Begründung zur Arbeitsdopplung, ist ein

Auftragnehmerwechsel gesamtwirtschaftlich nicht erstrebenswert.
