Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Gem. Bauwerksbuch und Bausubstanzuntersuchungen bestehen die Bestandswiderlager aus Mauerwerk und Beton. Im Leistungsverzeichnis sind die Abbruch- und Entsorgungspositionen entsprechend beschrieben. Im Zuge der Abbrucharbeiten zeigte sich, dass die Widerlager in der Mehrheit aus einem Sockel aus Sandsteinblöcken ,einem Bruchstein/Betongemisch und Natursteinen bestehen. Für den weichen Naturstein ist ein anderes Abbruchverfahren erforderlich. Die Ausführung der Bauleistung bleibt unverändert. Die Änderung resultiert aus Gründen, die der AN nicht zu vertreten hat und die vom AG trotz Sorgfalt (Bausubstanzuntersuchungen erfolgt) nicht vorausgesehen werden konnten.
