Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Varianten im Gewerk Tunnel und Verkehrsanlagen zu planen. Diese Anforderungen ergaben sich nach der fristgerechten

Einstellung der Trassierungsalternativen 1, 2 und 3 in die CDE (tp!) durch den Auftragnehmer

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die neuen Varianten können nur auf Grundlage der bereits erstellten Varianten erstellt werden. Durch die Einbindung eines

neuen AN wären die Kenntnisse zu den bereits erstellten Planungen nicht vorhanden. Somit würde ein deutlicher Mehraufwand

DB intern und bei einem neuen Planer durch Abstimmungen, Wissenstransfers und Koordinationsleistungen entstehen. Durch das

fehlende Wissen eines neuen Planers zu den Grundlagenabstimmungen der ursprünglichen Planung, wäre auch eine höhere

Anfälligkeit für Fehler zu erwarten.
