Geplant werden soll die Modernisierung und der barrierefreie Ausbau des Bahnhof (Bf) Budenheim. Der Bahnhof liegt an der Strecke 3510 Bingen Hbf - Mainz Hbf bei km 23,1. Vorgesehen ist die Erhöhung der Bahnsteige, Erneuerung der Beleuchtung der Elektro- und Beleuchtungsanlagen und Herstellung der Barrierefreiheit durch den Neubau von Rampenanlagen. Übertragen werden die Leistungsphasen 5-6 der Objektplanung Verkehrsanlage, Ingenieurbauwerk und Technische Ausrüstung. Sowie die Leistungsphasen 2-6 der Tragwerksplanung. Optionale werden die Leistungsphasen 7-9 der Planung Verkehrsanlage und Ingenieurbauwerk und die Leistungsphasen 7+9 der Technischen Ausrüstung ausgeschrieben. Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Da die Planung bereits durch den AN erfolgt ist, kann dieser die Ergänzungen und Änderungen in der Planung in Kürze erarbeiten. Ein neuer Planer müsste sich erst in die Planung einarbeiten und würde somit mehr Stunden benötigen, als der bereits vertraglich gebundene AN. Synergieeffekt durch einheitliche Leistungsdurchführung und Leistungsbetreuung gingen beim Wechsel des AN verloren.

Eine Vergabe an einen anderen AN wäre mit erheblichem Zeit- und Kostenaufwand verbunden. Um im Zeit- und Kostenrahmen nicht noch weiter in Verzug zu geraten, sind die zusätzlichen Leistungen der ausführenden Firma zwingend erforderlich.
