Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Art und Umfang der Änderungen (mit Angabe möglicher früherer Vertragsänderungen):

Der Leistungsinhalt umfasst die erneute Variantenuntersuchung hinsichtlich der Montage des Vorgesetzten Bauwerks inklusive der Überarbeitung des LVs, Baubeschreibung und Bauphasenplanung für das vorgesetzte Bauwerk EÜ Masurenstraße. Des Weiteren konnte aufgrund unerwarteter Bodenverhältnisse an der EÜ Dhünn die Gründungsrohre nicht nach Plan ausgeführt werden. Hierzu musste eine neue Statik mit kürzere Absetztiefe erstellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Fa. Vössing ist mit der Planung der vorgesetzten Bauwerke sowie die Erstellung der Ausschreibungsunterlagen für die Bauleistung beauftragt. Die vorgesetzten Bauwerke sind technisch miteinander verbunden und müssen gesamthaft durch einen Auftragnehmer nicht nur baulich, sondern ebenfalls planerisch betrachtet werden. Demnach ist ein AN-Wechsel aus technischen Gründen nich möglich. Die Beauftragung eines weiteren AN hat doppelte Kosten für die Einarbeitung in die Örtlichkeit zur Folge. Ein neuer AN müsste sich auch erst in die bisherige Planung einarbeiten, was bei dem neuen AN zu Mehrkosten führt. Die Vorzugsvariante müsste dann vom jetzigen AN wieder in die Gesamtplanung eingearbeitet werden, was hier wieder zu zusätzlichen Einarbeitung führt. Zudem müssen sich beide Auftragnehmer intensiv miteinander abstimmen, sodass dies einen erhöhten Aufwand und damit Mehrkosten auf Seiten beider AN zur Folge hat.
