Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Fa. Thales ist über den MV4 mit der Herstellung des ESTW-UZ Gelnhausen und zugehörigem ESTW-A Langenselbold beauftragt. Für die Abnahmeprüfung der Bestandssignale in den Stellbereichen der RSTW Langenselbold mit Wolfgang und Gelnhausen werden zwei Prüf-UZen benötigt.

Der AN ist mit der Herstellung des ESTW Gelnhausen für das Projekt beauftragt und führt diese aus. Der AN schuldet aufrund des Werkerfolgs zum Gesamtvertrag die zusätzliche Leistungserbringung, die in unmittelbarem Zusammenhang mit der beauftragten Leistung steht. Um die Inbetriebnahme des ESTW nicht zu gefährden, muss diese Leistung zwingend an Thales beauftragt werden.
