Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

LÄA 32 - Aufgrund der örtlichen Gegebenheiten ist das Mittelspannungskabel in einem Kabelkanal zu führen. Der Kabelkanal ist mit entsprechenden Blitzmarkierungen/ Abdeckungen zu versehen. Darüber hinaus ist das Mittelspannungskabel im Sand und mit einem zusätzlichen Flatterband zu verlegen.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Aufgrund der örtlichen Gegebenheiten ist das Mittelspannungskabel in einem Kabelkanal zu führen. Der Kabelkanal ist mit entsprechenden Blitzmarkierungen/ Abdeckungen zu versehen. Darüber hinaus ist das Mittelspannungskabel im Sand und mit einem zusätzlichen Flatterband zu verlegen. Die Zusatzkosten (Minderleistung) in Verbindung mit einer neuen Ausschreibung wären höher als die Kosten bei einer Nachtragsbeauftragung.
