                Um eine Korrektur des Vergabeverfahrens zu erreichen, kann ein Nachprüfungsantrag bei der Vergabekammer

                der Bezirksregierung Münster gestellt werden, solange der Auftraggeber nach keinen wirksamen Zuschlag

                erteilt hat. Ein wirksamer Zuschlag kann erst erstellt werden, nachdem der Auftraggeber die unterlegenen

                Bieter über die beabsichtigte Zuschlagserteilung informiert hat und 15 Kalendertage bzw. bei Versendung der

                Information per fax oder auf elektronischem Weg 10 Kalendertage vergangen sind. Ein Nachprüfungsantrag

                ist unzulässig, wenn der Antragsteller die geltend gemachten Verstöße gegen Vergabevorschriften bereits

                im Vergabeverfahren erkannt und gegenüber dem Auftraggeber nicht unverzüglich und in der Regel vor

                Anrufung der Vergabekammer gerügt hat bzw. wenn der Antragsteller Vergabeverstöße, die bereits aufgrund

                der Bekanntmachung oder den Vergabeunterlagen erkennbar waren, nicht spätestens bis zum Ablauf der Frist

                zur Angebotsabgabe oder zur Bewerbung gerügt hat. ferner ist ein Nachprüfungsantrag unzulässig, wenn

                mehr als 15 Kalendertage nach Eingang der Mitteilung des Auftraggebers, eine Rüge nicht abhalfen zu wollen,

                vergangen sind (§ 160 Abs. 3 GWB).
