Zuständig für die Nachprüfung von Vergabeverfahren ist das

Bundeskartellamt- Vergabekammern des Bundes, Villemombler Str. 76, 53123 Bonn,

Gemäß § 160 Abs. 3 Nr. 1 GWB müssen erkannte Verstöße gegen Vergabevorschriften innerhalb einer Fristvon 10 Kalendertagen bei der Vergabestelle des Bundesamtes für Bauwesen und Raumordnung, Referat A4, Straße des 17. Juni 112 in 10623 Berlin, gerügt werden, Verstöße gegen Vergabevorschriften, die sich ausdiesem Bekanntmachungstext oder aus den Vergabeunterlagen ergeben, müssen innerhalb der Angebots- bzw.Bewerbungsfrist gerügt werden, § 160 Abs. 3 Nr. 2 GWB.

Hilft die Vergabestelle der Rüge nicht ab, kann ein Antrag auf Nachprüfung beim Bundeskartellamt unter dero.g. Anschrift innerhalb von 15 Kalendertagen nach Eingang der Mitteilung des Auftraggebers, der Rüge nichtabhelfen zu wollen, gestellt werden. Der Nachrüftungsantrag ist unzulässig, soweit die Voraussetzungen von §160 Abs. 3 GWB vorliegen.

Die Vergabestelle weist ferner auf die Vorschriften der §§ 134, 135 GWB hin. Insbesondere sind dieFristenregelungen in § 135 Abs. 2 GWB zur Geltendmachung der in § 134 Abs. 1 GWB genannten Verstöße zubeachten.

Die Nachtragsvereinbarung ist zwingend erforderlich, da die angebotene Leistung zur Erbringung des Hauptauftrags erforderlich ist. Die gesetzlichen Anforderungen des § 132 Abs. 2 Nr. 2 GWB werden durch den vorliegenden Sachverhalt erfüllt. Ein Wechsel des Auftragnehmers aus wirtschaftlichen oder technischen Gründen kann nicht erfolgen und wäre mit erheblichen Schwierigkeiten oder beträchtlichen Zusatzkosten für den öffentlichen Auftraggeber verbunden.
