Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nach Ablauf der jeweiligen Frist kann eine Unwirksamkeit nicht mehr festgestellt werden.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Die Kabeltrasse im Querschlag Versorgungsschacht muss zwischen Kabelschacht Nr. 11 und Nr. 12, so wie im Zuge der

Ausführungsplanung abgestimmt, hergestellt werden. Damit die geplanten 3x DN 110 Kabelleerrohre hergestellt werden

können, ist der unbewehrte Aufbeton des Bodens so weit wie nötig zu entfernen.

Ein Wechsel des AN ist aus technischer Sicht nicht möglich. Der Tunnel-Rohbau, somit auch der QS VS, wurde in einer VOBAbnahme

an die durch die ARGE TuRa an die ausbauende ARGE übergeben. Beide Unternehmen arbeiten weiterhin parallel

im Tunnel. Die Arbeiten am Kabelschacht des QS VS muss die Fa. Eiffage somit in ihren Bauablaufplan an die Zuwegigkeit

der Ost- und Weströhre eintakten und kann somit diese Arbeiten auch nachts ausführen. Ein terminplanerisches Risiko ist

somit minimiert. Ein Wechsel des AN ist mit erheblichen Schwierigkeiten im Bauablauf des Ausbaus im Querschlag VS

verbunden. Umplanungen im Einbaus des Sohlbetons in den Haupttunnelröhren, zB durch eine priorisierte, logistische

Zuwegung in das Schachtbauwerk, verursachen außerdem Zusatzkosten durch die längere Vorhaltung von Personal und

Baufahrzeugen
