Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):

Im Rahmen der Fortschreibung der verkehrlichen Aufgabenstellung (VAst) für das Projekt Brenner-Nordzulauf wurden sog. Modellzüge (Zuglänge + Zuggewicht) zusammengestellt. Auf Grund dieser Vorgaben müssen Untersuchungen zur Grenzlast durchgeführt werden. Ziel dieser Untersuchungen ist der Nachweis, dass alle Modellzüge die Strecke hindernisfrei befahren können. Da im Bereich der Verknüpfungsstelle Ostermünchen Streckenwechsel mit höhenfreien Kreuzungen vorgesehen sind, gibt es hier Überwerfungsbauwerke mit Rampen, um die Höhenunterschiede zu überwinden. Diese Rampen können zum Teil mit den Modellzügen nicht hindernisfrei befahren werden. Deshalb ist zu untersuchen, ob durch die Anpassung der Rampenneigung von ca. 12,5 auf 9 Promille die Hindenisse beseitigt werden können. - MKA 03

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Dem verhältnismäßig geringen Umplanungsaufwand, ständen beim einem Wechsel des Bearbeiters sehr große zeitliche und damit auch große Kostenaufwände gegenüber. Für die Planungen sind umfangreiche Grundlagendermittlungen, Erhebungen von Zwangspunkten, die Einarbeitung in die Planungsstände, Abstimmungen mit Dritten und der sehr vielen Projektbeteiligten, Ortskenntnisse, System/-Softwarezugänge, Schulungen, Prozesse etc. notwendig. Des Weiteren liegen dem AN die ursprünglichen Planunterlagen (2D, 3D, BIM) vollständig vor.
