Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Wechsel des AN ist aus technischen Gründen nicht möglich:

Bei einem Wechsel wäre der Mängelanspruch nicht mehr genau definierbar bzw. gewährleistet, da ein Großteil der Leistung vom

aktuellen AN bereits erbracht wurde. Zudem hatte der AN bereits mehrere Materialien und Türen mit Reserve in Bestellung

aufgenommen und eingelagert. Dies würde zu logistischen Schwierigkeiten führen, die mit erheblichen Verzögerungen verbunden

wären.

Wechsel des AN ist mit erheblichen Schwierigkeiten oder Zusatzkosten verbunden:

Auch unter Berücksichtigung von Beschleunigungsmaßnahmen wäre die IBN gefährdet. Dies hätte erhebliche Auswirkungen auf

den Fahrplan und wäre mit beträchtlichen Zusatzkosten verbunden.
