         Die Auftraggeberin beabsichtigt, ihren Tarifbeschäftigten durch Entgeltumwandlung das E-Dienstradleasing anzubieten. Dem liegt der Tarifvertrag zur Entgeltumwandlung zum Zwecke des Leasings von Fahrrädern im kommunalen öffentlichen Dienst (TV-Fahrradleasing) zugrunde.

         Gegenstand der Ausschreibung ist deshalb eine Rahmenvereinbarung über die Bereitstellung von E-Fahrrädern im Wege des Leasings (Teilamortisierungsleasing) gemäß TV-Fahrradleasing zum Zwecke der Überlassung an Tarifbeschäftigte zur dienstlichen und privaten Nutzung einschließlich Versicherungs-, Schulungs- und Serviceleistungen (insbesondere Abwicklung der Bestell-, Rückgabe- und Schadenabwicklungsprozesse, Wartung, Reparatur und Ersatz, Störfallmanagement und Bereitstellung eines Online-Portals).

      4. Description of the procurement:
         

         Die Gemeinde Ostseebad Heringsdorf beabsichtigt, berechtigten Bediensteten im Rahmen eines Dienstradleasingmodells E-Diensträder (auch Pedelecs) zur dienstlichen und privaten Nutzung zu überlassen. Es ist beabsichtigt, eine Rahmenvereinbarung über die Versorgung mit E-Diensträdern als Leasing und die damit verbundenen Abwicklungsprozesse sowie Dienstleistungen abzuschließen. Der Auftragnehmer ist für die vollständige Leistungserbringung verantwortlich. Er sorgt dafür, dass das angebotene E-Dienstradleasingmodell mit den gesetzlichen Bestimmungen und den steuerlichen Regelungen im Einklang steht und dem Zweck entsprechend durchgeführt werden kann. Die Inanspruchnahme des Angebotes zur Nutzung des E-Dienstrades ist für die Bediensteten freiwillig. Es bestehen daher keinerlei Abnahmeverpflichtungen. Die Rahmenvertragsdauer beträgt 48 Monate ab Auftragsvergabe. Die Vertragslaufzeit der Einzel-Leasingverträge beträgt 36 Monate. Die Bediensteten sind angehalten, das E-Dienstrad-Leasing in den ersten 12 Monaten der Rahmenvertragslaufzeit in Anspruch zu nehmen.

         Die Rahmenvereinbarung begründet keinen Anspruch des Auftragnehmers auf Abruf einer bestimmten Jahresmenge. Eine Mindestabnahmemenge wird nicht vereinbart. Die geschätzte Abnahmemenge ist 50 Fahrräder. Es gilt eine verbindliche Höchstabnahmegrenze von 65 Fahrädern.

          Aufgrund der nicht exakt bestimmbaren Auftragshöhe wird trotz wahrscheinlicher Unterschreitung der EU-Schwellenwerte eine freiwillige europaweite Bekanntmachung / Ausschreibung durchgeführt. Es ergeht der ausdrückliche Hinweis der fehlenden Bindung an das Kartellvergaberecht.
