Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Der Wechsel des AN ist aus wirtschaftlichen Gründen nicht möglich: Da die Sprinklerung der Schächte mit der Anpassung der Sprinklerung B1- und B2-Ebene zusammenhängt, würde bei Wechsel des AN der Mängelanspruch verloren gehen. Die Leistungsgrenzen müsste hierbei neu definiert werden, da sonst keine einheitliche Leistungsdurchführung und Leistungsbetreuung möglich wäre. Dies wäre in so kurzer Zeit nicht möglich.

Der Wechsel des AN ist mit erheblichen Schwierigkeiten oder Zusatzkosten verbunden: Auch unter Berücksichtigung von Beschleunigungsmaßnahmen wäre die IBN gefährdet. Dies hätte erhebliche Auswirkungen auf den Fahrplan und wäre mit beträchlichen Zusatzkosten verbunden.
