Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. MKA003: Zusätzlicher Einsatz von Sicherungsaufsicht im Bereich Wirtheim

Entgegen der Annahmen im Hauptvertrag kommt verstärkt der Einsatz von Sicherungsaufsicht, anstelle ATWS zum Einsatz.

Der AN ist bereits mit der Sicherung der Baumaßnahmen der Vorabmaßname ESTW Gelnhausen beauftragt und in den entsprechenden Systemen, Betras & Sicherungsplänen hinterlegt. Ein Wechsel des AN würde eine Teilkündigung bedingen, die zu einer rechtlichen Klärung führen müsste. Der AN ist zudem noch mit weiteren Leistungen beauftragt, für die er leistungsfähig & - bereit ist.
