Section III
1. Conditions for participation:
  1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
    List and brief description of conditions:
    Mit den Angebotsunterlagen sind Angaben zum Bieter (Geschäftssitz, Name und Anschrift der zuständigen Niederlassung) einzureichen.
    
    Darüber hinaus ist eine Eigenerklärung mit folgendem Inhalt abzugeben.
    
    Mit der Abgabe des Angebotes erklärt der Bieter bzw. die Bietergemeinschaft ausdrücklich, dass
    
    - er /sie das Gewerbe angemeldet hat und die gesetzlichen Verpflichtungen erfüllt bzw. beachtet und die krankenversicherungspflichtigen Arbeitnehmer bei der
    
    Krankenkasse angemeldet hat.
    
    - er /sie das Gesetz zur Bekämpfung der Schwarzarbeit und illegalen Beschäftigung vom 23.07.2004 (in der geltenden Fassung) beachtet.
    
    - er /sie nicht aufgrund eines rechtskräftigen Urteils aus Gründen bestraft worden ist, die die berufliche Zuverlässigkeit in Frage stellen.
    
    - das Angebot auf autonomer sowie betriebsindividueller Kalkulation und Preisbildung beruht und in keinem Zusammenhang mit wettbewerbsbeschränkenden Abreden oder sonstigen Vereinbarungen ähnlicher Art steht.
    
    - er /sie bei Vertragsabschluss über eine ausreichende Betriebshaftpflichtversicherung verfügen wird, die das Risiko der Leistungen
    
    abdeckt. Eine aktuelle Police der Haftpflichtversicherung wird dem Auftraggeber auf Verlangen vorgelegt.
    
    - keine Verfehlungen vorliegen, die seinen /ihren Ausschluss von der Teilnahme am Wettbewerb rechtfertigen können, wie beispielsweise nach § 6 Arbeitnehmer-Entsendegesetz oder gem. § 5 KorruptionsbG NRW zu einem Eintrag in das Vergaberegister führen könnten.
    
    Der Bieter/die Bietergemeinschaft versichern zusätzlich, dass die in §§ 123, 124 GWB aufgeführten Ausschlusstatbestände nicht auf sie zutreffen. Sofern abweichend hiervon ein oder mehrere Ausschlusstatbestände zutreffen sollten, sind diese in einer separaten Anlage zu erläutern und die ggf. getroffenen Maßnahmen gem. § 125 GWB darzustellen.
    
    Zudem ist eine Erklärung abzugeben, ob sich der Bieter bzw. die Bietergemeinschaft in einem Insolvenzverfahren befindet.
    
    Im Weiteren ist eine Erklärung abzugeben, dass die Voraussetzungen für einen Ausschluss nach § 19 Abs. 1 MiLoG nicht vorliegen.
    
    Der Bieter ist sich bewusst, dass eine im Vergabeverfahren abgegebene vorsätzlich unzutreffende Erklärung in Bezug auf seine Eignung zum Ausschluss von der Teilnahme am Wettbewerb führen kann.
    
    Der Auftraggeber wird ermächtigt, jederzeit die vom Bieter getätigten Angaben zu überprüfen und entsprechende Auskünfte einzuholen oder Bestätigungen zu verlangen.
    
    Der Auftraggeber behält sich ausdrücklich vor, fehlende Angaben und Erklärungen nachzufordern sowie die Angaben des Bieters zu überprüfen und zu diesem Zweck belastbare Nachweise vom Bieter zu verlangen.

  Nach § 160 Absatz 3 des Gesetzes gegen Wettbewerbsbeschränkungen (GWB) ist der Antrag auf Einleitung eines Nachprüfungsverfahrens vor der Vergabekammer unzulässig, soweit
  
  1. der Antragsteller den geltend gemachten Verstoß gegen Vergabevorschriften vor Einreichen des Nachprüfungsantrags erkannt und gegenüber dem Auftraggeber nicht innerhalb einer Frist von zehn Kalendertagen gerügt hat; der Ablauf der Frist nach § 134 Absatz 2 bleibt unberührt,
  
  2. Verstöße gegen Vergabevorschriften, die aufgrund der Bekanntmachung erkennbar sind, nicht spätestens bis zum Ablauf der in der Bekanntmachung benannten Frist zur Bewerbung oder zur Angebotsabgabe gegenüber dem Auftraggeber gerügt werden,
