Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

m Rahmen der Einbindung des Sozialgebäude der Leitstelle Leverkusen-Küppersteg in die 50 Hz Energieversorgung, sind zusätzliche Leistungen erforderlich geworden.

Für die Einführungen der Versorgungsleitung in die Außenverteilung ist eine DN 110 Kernbohrung unterflur

herzustellen. Die Versorgungsleitung ist mit einer Ringraumabdichtung (Hauf-System) einzuführen und

abzudichten.Die Kabelführung der Versorgungsleitung ist hinter den Außenverteilerschränken der DB Netz fachgerecht

herzustellen

Die Herstellung zur Einbindung des LST-Sozialgebäude in Leverkusen Küppersteg ist eine vertraglich geschuldete Leistung. Die oben beschriebenen Leistungen sind für den Werkerfolg erforderlich und ändern nicht den Charakter des Vertrags.
