Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nature and extent of the modifications (with indication of possible earlier changes to the contract):

NT0010 - Teilprojekt 2 - erforderliche Umplanungen und Wiederholungen aufgrund der Erhöhung der Entwurfsgeschwindigkeit - Anschreiben - Anmeldung der Nachtragsleistung - Kalkulation

Die im Nachtragsangebot NTIO des AN beschriebenen Leistungen (Berücksichtigung Deutschlandtakt in der Planung: Anhebung auf 100 Km/h, Ergänzung eines Begegnungsabschnitts, Anpassung eines Kreuzungsbahnhofs und angepasste Zugzahlenprognose) sind erforderlich, um die Vorplanung gemäß der aktualisierten EBMJ Prognose 2030 DT, welche aus der geforderten Berücksichtigung des Deutschlandtaktes durch das BMDV resultiert, gewährleisten zu können.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Die zusätzlichen Leistungen sind für die erfolgreiche Erbringung des vertraglich vereinbarten Planungsauftrags, welcher durch die aktualisierte Prognose 2030 DT zusätzlich geschärft wurde, erforderlich. Zur Wahrung der Termintreue ist die Vergabe dieser Leistung an den Auftragsnehmer erforderlich, andernfalls drohen erhebliche Verzüge der Ausführung sowie Mehrkosten durch angezeigte Behinderungen des Auftragnehmers. Bei erneuter Ausschreibung der Leistung würde sich zudem ein erheblicher Verzug des Fertigstellungstermins durch den AN Planung ergeben.
