Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Um die vertraglich vereinbarte Leistung der Bohrpfahlherstellung an der EÜ (FU) Windthorstraße erbringen zu können, ist die Verlängerung der Bohrpfähle erforderlich geworden, da ein Absetzen der Bohrpfähle erst in größerer Tiefe möglich war, als es vertraglich in Aussicht gestellt wurde. Hierfür ist die Statik teilweise erneut zu erstellen, die Ausführungsplanung zu überarbeiten und es hat die Leistungsausführung entsprechend zu erfolgen. Die ARGE RRX PA 1.2 Leverkusen ist mit der Planung und der Bauausführung der EÜ (FU) Windthorstraße beauftragt. Folglich ist die Verlängerung der in diesem Rahmen herzustellenden Bohrpfähle als zusammenhängende Leistung zu betrachten, die aus technischen, wirtschaftlichen und Gewährleistungsgründen von ihr ausgeführt werden sollte.
