Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Nature and extent of the modifications (with indication of possible earlier changes to the contract):

LÄA 52 - Demontieren der senkrechten Blechverkleidung (Wange / Geländer) an den Fahrtreppen innerhalb der Treppenhäuser – die Ausführung erfolgt durch die Fa. Schindler Fahrtreppen.

Da nur so die vertraglichen Leistungen (Demontage und Erneuerung der Wandbekleidung) ausführbar sind => erforderliche Vorleistungen.

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Ein weiterer AN würde zusätzliche Schnittstellen schaffen, die koordiniert und zeitlich eingetaktet werden müssen. Unnötige Zusatzkosten wie eine doppelte BE, zusätzliche Personen in Besprechungen, etc können so verhindert werden. Die Synergieeffekte bei Beauftragung der Leistungen bei einem AN sollten ebenfalls genutzt werden um zusätzliche Kosten zu vermeiden. Somit können diese Leistungen nur beim AN Firma Rommel Infrastrukturbau GmbH & Co. KG angesiedelt werden. Bei einer getrennten Vergabe wäre eine erneute BE mit zusätzlichen Gerätetransporten erforderlich.

Wie bereits unter c) schon beschrieben, würde ein zusätzlicher AN zusätzliche Schnittstellen schaffen, die koordiniert und zeitlich eingetaktet werden müssten. Die Synergieeffekte bei Beauftragung der Leistungen bei einem AN sollten ebenfalls genutzt werden um zusätzliche Kosten zu vermeiden. Die Beschaffung der benötigten Leistungen von einem anderen Unternehmen ist zwar möglich, hinsichtlich des zusätzlichen Aufwandes und
