Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Aufgrund notwendig gewordener Damm- und Erdbauarbeiten Dritter im Nordwest-Bereich der Eisenbahnüberführung EÜ-Dühnn bis zur EÜ (FU) Windhorststraße, sind die auf den dortigen Baustelleneinrichtungsflächen gelagerten Geräte und Materialien für ca. eine Woche von diesen BE-Flächen zu räumen. Die dafür erforderlichen Transporte und Zwischenlagerungen sind vertraglich nicht vereinbart.

Der AN (Fa. Echterhoff) ist gemäß den vertraglichen Vereinbarungen zum Los VE1541 zur Nutzung der in Bauwerksnähe bereitgestellten Baustelleneinrichtungsfläche berechtigt. Vorhandene Baustraßen können in Abstimmung mit anderen (zur Nutzung berechtigten Dritten) ebenfalls befahren werden. Die im Zusammenhang mit Dritten temporär notwendige Räumung der BE-Fläche kann aus terminlichen, sowie wirtschaftlichen Gründen kaum sinnvoll an einen weiteren Auftragnehmer vergeben werden.
