Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

42 - es handelt sich um eine geänderte Leistungen zur Herstellung der Innenwänden im Bereich der Räumlichkeiten der

Rauchabzugsventilatoren, welche im ursprünglichen Bauvertrag nicht enthalten sind. Aus technischen Gründen kann kein anderer

Auftragnehmer diese zusätzlichen Arbeiten ausführen, da der derzeitige Auftragnehmer bereits bei der Errichtung des Bauwerks

tätig ist. Darüber hinaus ist es aufgrund der zusätzlichen Schnittstellen, die durch die in diesem Nachtrag aufgeführten Leistungen

entstehen, aus Gewährleistungsgründen nicht sinnvoll, diese zusätzlichen Leistungen von einem Dritten ausführen zu lassen. Ein

AN-Wechsel für die Leistungen des hier behandelten Nachtrages hätte zur Folge, Verzögerungen im RTP sowie zugehörende

Kostenüberschreitungen. Die Baufirma ist bereits vor Ort tätig und kann schnell reagieren, um Verzögerungen der

Sperrpausenabhängige Vorgänge (relevant für IBN) vom RTP sowie zugehörende Kostenüberschreitungen zu vermeiden.
