Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Im Zuge der Herstellung der Erweiterung der vorhandenen Personenunterführung von der Bestands-PU zum neuen Treppenaufgang (für das neue Gleis des RRX) der Eisenbahnüberführung EÜ (FU) Katzbergstraße, wurde eine Höhendifferenz zwischen der Decke der Bestands-PU (55cm) und der geplanten Decke der PU-Erweiterung (50cm) festgestellt. Die Decke der PU-Erweiterung ist daher (unter Berücksichtigung der LSW-Gründung) bis zum Anschluss an die Bestands-PU entsprechend dem erforderlichen (bzw. durch den Bestand gegebenen) Quergefälle oberseitig auf 55cm verstärkt herzustellen.

Der AN (Fa. Echterhoff) ist gemäß Hauptvertrags-LV umfänglich mit der Herstellung der Erweiterung der vorhandenen Personenunterführung als Rahmenbauwerk in Ortbetonbauweise beauftragt. Die Verstärkung der Decke der PU-Erweiterung von 50cm auf 55cm kann kaum von den bereits vereinbarten Vertragsleistung getrennt werden. Die Vergabe dieser zusätzlichen Leistung an einen weiteren Auftragnehmer ist aus terminlichen, sowie wir
