Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nature and extent of the modifications (with indication of possible earlier changes to the contract):

NT54 - Weiterführung von Workshops zum Thema "Big Picture Finanzierung" im Jahr 2023 für die Bauabschnitte BA 50 und BA 60 inkl. Ersatzmaßnahmen mit folgenden Teilleistungen:

• Organisation und Leitung von 4-wöchentlichen Jour-Fixes, um alle den Bauabschnitt betreffenden Finanzierungsvorgänge aufzuklären

• Aktualisierung der Terminketten und Übertragung von Ergebnissen aus dem Big Picture in den Steuerungsterminplan und umgekehrt

• Analyse und Beratung hinsichtlich etwaiger Problemstellungen

• Erfassung, Dokumentation und Nachverfolgung der Aufgaben aus den Jour-Fixes über Contrace

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

NT54 - Ein zusätzlicher AN müsste sich durch mehrmonatige Einarbeitung umfangreiches Projektwissen aneigenen, insbesondere in der Bewertung der vielschichtigen techn. Schnittstellen und komplexen Kostenstrukturen des Großprojekts. Zum einen würden die Kosten einer adäquaten Einarbeitung für einen neuen AN die avisierten Kosten der Nachtragsleistung überproportional erhöhen, zum anderen entstehen erhebliche Verzögerungen im Leistunsgablauf, die die enge Terminschiene im Gesamtprojekt weiter belasten. Darüber hinaus ist bei Durchführung der o.g. Leistungen durch einen weiteren AN keine eindeutig nachvollziehbare Trennung der Aufgaben mehr möglich, da die zusätzliche Leistung eng verzahnt ist mit den hauptvertraglichen Terminserien. Die Zuordnung der Verantwortlichkeiten wäre im Weiteren nicht nachvollziehbar, so dass sich erhebliche Schnittstellen- und Kommunikationsproblematiken ergeben würden, insbesondere unter Anbetracht der sensiblen Informationen zu den Gesamtkosten und -terminen.
