Die Geltendmachung der Unwirksamkeit einer Auftragsvergabe in einem Nachprüfungsverfahren ist fristgebunden. Es wird auf die in § 135 Abs. 2 GWB genannten Fristen verwiesen. Nach § 135 Abs. 2 S. 2 GWB endet die Frist zur Geltendmachung der Unwirksamkeit 30 Kalendertage nach Veröffentlichung der Bekanntmachung der Auftragsvergabe im Amtsblatt der Europäischen Union. Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Aufgrund eines baulichen Hindernisses bei der LSW-Herstellung bei km 12,161 bahnlinks nördlich der Stützwand IV (Los VE1241) sind zusätzliche Planungs- und Bauleistungen erforderlich, um den Lückenschluss zwischen der LSW III (km 12,161) und der LSW III(e) auf der Eisenbahnüberführung EÜ-Dhünn bei km 12,174 (Los VE1541) herzustellen.

Der AN (Fa. Echterhoff) ist gemäß den vertraglichen Vereinbarungen mit der Herstellung der Lärmschutzwand LSW III(e) auf der EÜ-Dhünn ab km 12,174 beauftragt, und kann in diesem Rahmen auch den Lückenschluss zwischen den Lärmschutzwänden herstellen. Die Vergabe dieser zusätzlichen Planungs- und Bauleistung an einen weiteren Auftragnehmer ist aus terminlichen, sowie wirtschaftlichen Gründen nicht sinnvoll.
