Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Im Rahmen der Ausführungsplanung sowie der Bauausführung lässt es sich auch mit größtmöglicher Sorgfalt nicht vermeiden, dass sich weitere Zwangspunkte, Randbedingungen und auch Verschiebungen ergeben. Im vorliegenden Fall sind häufige Veränderungen der Vorschriften sowie Vorgaben der oberen Behörde ohne Verschuldendes Auftragnehmers eintreten und es entstand ein zusätzlicher Vergütungsanspruch. Der vorgesehene und angebotene Zeitrahmen ist dafür angemessen und nachvollziehbar. Somit ist die Änderung aufgrund von Umständen erforderlich geworden, die der Auftraggeber im Rahmen seiner Sorgfaltspflicht nicht vorhersehen konnte. Der Gesamtcharakter des ursprünglichen Auftrags verändert sich durch den Nachtrag nicht.
