Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Difficultés du Titulaire à exécuter l"accord-cadre dans les conditions contractuelles initiales. Les prestations sont exposées aux perturbations économiques actuelles. Les Parties ont échangé sur la prise en compte des conséquences liées à la situation impactant le cours des matières premières, de l"énergie et des pénuries de composants, nécessaires à l"exécution de l"accord-cadre, du fait de la guerre en Ukraine. Il est constaté que l"évènement est imprévisible en tant que, à la date de la conclusion de l"accord-cadre, la hausse du coût de ces matières n"était ni connu ni prévisible, dans sa survenance et qu"il dépasse les aléas ordinaires, que les Parties pouvaient raisonnablement envisager lors de la conclusion de l"accord. Le Titulaire démontre également faire face à des difficultés dans l"exécution de l"accord-cadre dans des conditions équilibrées.
