VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):

En conséquence de la crise mondiale et compte tenu de la hausse particulièrement importante des coûts des matières premières des produits et du transport pratiqués par les fabricants, la présente modification a pour objet de prendre en compte sans incidence financière sur le montant maximum de l’accord-cadre, une revalorisation du prix n°1 du BPU « carton petit modèle ».

De ce fait, le prix susmentionné qui s’élevait à 0.70€ HT, est modifié conformément au BPU joint en annexe, et s’élève désormais à 1.01 € HT. Les autres postes du BPU ne sont pas impactés.

Toutefois, en référence à la jurisprudence traditionnelle, afin que le risque encouru lors de l’attribution de l’accord-cadre puisse être supporté d’une part par le pouvoir adjudicateur et d’autre part par le titulaire, le BPU modifié prend en compte uniquement 90% de la marge commerciale initiale du titulaire.

Cet acte modificatif est passé conformément à l’article R2194-5 du Code de la Commande Publique et à l’avis du Conseil d’Etat n°405540 du 15 septembre 2022.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
