        ARTICLE 3 – Obligations des titulaires

        3-1 - Assurance

        Les titulaires devront disposer d’un contrat d’assurance couvrant leur responsabilité civile et professionnelle à l’égard des tiers pour tous les dommages corporels, matériels et immatériels pouvant survenir à l’occasion de l’exécution du marché, y compris les erreurs, fautes, omissions ou retards dans l’exécution des prestations.

        La preuve sera matérialisée par la remise d’une copie de la ou des police(s) d’assurance et de ses annexes en cours de contrat dans le mois qui suit l’échéance annuelle du contrat d’assurance par une attestation de renouvellement du ou des contrat(s) avec indication éventuelle des avenants.

        En cas de changement de compagnie, les titulaires devront fournir une copie du ou des nouveau(x) contrat(s).

        3-2 - Confidentialité

        Le titulaire est tenu, ainsi que l’ensemble de son personnel et, le cas échéant, de ses sous-traitants et fournisseurs, au secret professionnel et à l’obligation de discrétion pour tout ce qui concerne les faits, informations, études ou décisions dont il a ou aura eu connaissance durant l’exécution du marché.

        ARTICLE 4 – Modalités d’exécution ou de livraison

        4-1 - Horaires de livraison

        Les titulaires devront respecter les horaires, fréquences de livraison fixés par chaque établissement selon les protocoles annexés.

        Elles devront être conformes à l’arrêté du 8 octobre 2013 relatif aux règles sanitaires applicables aux activités de commerce de détail, d"entreposage et de transport de produits et denrées alimentaires autres que les produits d"origine animale et les denrées alimentaires en contenant.

        4-2 - Quantités

        Les quantités sont portées sur l"état des besoins ci-joints pour chaque lot : elles peuvent varier de plus ou moins 20%.

        Les quantités indiquées sur chaque Bordereau des Prix (BPU) correspondent aux besoins pour le fonctionnement normal sur une année civile. En cas de pandémie et/ou d’obligation de fermeture des services de restauration, les quantités annoncées ne pourraient pas être respectées et devraient être revues à la baisse au prorata de la durée effective de fonctionnement.

        4-3 – Définition des commandes

        Les bons de commandes seront établis au fur et à mesure des besoins.

        4-4 -Qualité

        Les produits, quels que soient leur préparation, conditionnement ou présentation devront répondre à toutes les normes en vigueur pour la restauration collective.

        4-2-1 – Contenu du dossier remis par le candidat

        La totalité des offres des candidats sera entièrement rédigée en langue française. Il est rappelé que le ou les signataires doivent être habilités à engager le candidat.

      Le paiement des sommes dues au titre des marchés s’effectue selon les règles de la comptabilité publique, et en particulier en application du décret n° 2018-1075 du 3 décembre 2018 relatif à la lutte contre les retards de paiement dans les contrats de la commande publique.

      - l’agent comptable du Lycée Victor Hugo pour les établissements relevant de son agence comptable,

      - l’agent comptable du Lycée Polyvalent Saint-Exupéry pour les établissements relevant de son agence comptable,

      - l’agent comptable du Lycée Hôtelier d’Occitanie pour le collège du Bois de la Barthe à Pibrac.

      Elles auront été visées au préalable par la personne habilitée désignée

      Les offres devront être parvenues au plus tard le 15 septembre 2023 à 17 heures au service de gestion du :
