La consultation est un appel d’offres ouvert européen en application des articles 25 et 66 à 68 du décret n°2016-360 du 25 mars 2016 relatif aux marchés publics.

Compte tenu du nombre et du volume incertain des commandes passées par le service Restauration, le présent marché est un accord-cadre à bons de commande passé selon les dispositions de l’article 78 du décret n°2016-360 du 25 mars 2016 relatif aux marchés publics. Les seuils des commandes à intervenir sont les suivants :

- Montant minimum annuel : 30 000 euros HT

- Montant maximum annuel : 90 000 euros HT

VII.2)Information about modifications

VII.2.1)Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

En cours d’exécution du marché, le titulaire doit faire face à des circonstances imprévues, liées aux conditions économiques nouvelles du fait de la crise sanitaire et du conflit russo-ukrainien. Plus précisément, il subit une hausse du prix des matières premières (notamment pour les produits tels que les rouleaux d’aluminium, les rouleaux de film plastique, les nappes en papier, les housses pour échelles alimentaires, les sacs en plastique, les poches à pâtisserie, le papier cuisson, etc.), une hausse du coût d’achat des emballages, une hausse du coût de l’énergie ou encore une hausse du coût du frêt maritime pour certains produits. Il doit également faire face à des difficultés d’approvisionnement pour certaines matières premières et à une envolée de ses coûts de fabrication et de distribution.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

En application des recommandations de la circulaire n°6374/SG du 29 septembre 2022 relative à l’exécution des contrats de la commande publique dans le contexte actuel de hausse des prix de certaines matières premières, et conformément à l’article R.2194-5 du code de la commande publique, il convient de modifier les prix figurant au Bordereau des Prix Unitaires.Les fournitures commandées font l’objet d’un nouveau Bordereau des Prix Unitaires.Les nouveaux prix du B.P.U. s’appliqueront à compter de la notification de l’avenant n°2, jusqu’à la fin du marché (soit le 31 décembre 2022).
