Explanation:

Hankinta toteutetaan julkisista puolustus- ja turvallisuushankinnoista annetun lain (1531/2011, jäljempänä puolustus- ja turvallisuushankintalaki) nojalla. Hankinnan kohde on puolustus- ja turvallisuushankintalain 5 §:n 2 momentin 2 kohdan tarkoittama palvelu, joka kohdistuu suoraan 5 §:n 2 momentin 1 kohdan tarkoittaman tavaran elinkaareen. Hankinnan kohde kuuluu sotatarvikeluettelon tulkinta-apuna käytettävän EU:n yhteisen puolustustarvike luettelon (2023/C 72/02) kohtaan ML10 (Sotilaskäyttöön tarkoitetut ilma-alukset ja niihin liittyvä varustus), koska NH90-helikopterin on suunniteltu sotilaalliseen käyttöön ja hankittavaksi esitetty palvelu on NH90-helikopterin RTM322-moottoriin kohdistuvaa tuotetukipalvelua.

Hankinta tehdään suorahankintana puolustus- ja turvallisuushankintalain 22 §:n 1 momentin 3 kohdan perusteella. Valittu toimittaja on NH90-helikopterin RTM322-01/9 moottorin alkupe-räinen valmistaja ja teknisin syin ainoa huolto-, korjaus- ja modifikaatiopalveluja tuottava toimittaja, joka voi tehdä NH90-helikoptereiden moottoreiden huolto- ja korjauspalvelut. Tamä palvelu voidaan hankkia vain NH90-helikopterin RTM322-01/9 moottorin Original Engine Manufacturer (OEM) valmistajalta Safran Helicopters Engines Germanylta, koska ainoastaan sillä on kyky tehdä tehdä RTM322 moottorin laitteiden korjaukset. Materiaalin laatuvaatimukset sekä kriittisyys lentoturvallisuudelle asettavat tarkat rajoitukset materiaalin käsittelylle, varastoinnille ja seurattavuudelle valmistuksesta aina käyttöönottoon asti. Ainoastaan alkuperäisvalmistaja voi tarjota hankinnan kohteena olevaa palvelua RTM322-01/9 -moottoriin.
