Sopimusmuutoksella puitesopimukseen lisätään uusi ehto, joka mahdollistaa ennakoimattomista olosuhdemuutoksista johtuvien poikkeuksellisten saatavuuspoikkeusten tekemisen väliaikaisesti.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Heliumin tuotannossa ja toimittamisessa on tapahtunut sodasta ja yllättävistä tapahtumista johtuvia olosuhdemuutoksia. Tapahtumat ovat olleet sellaisia, joita Hansel ei ole voinut ja osannut ennakoida puitejärjestelyä valmistellessaan. Myöskään huolellisesti menetelleen

toimittajan ei ole voitu olettaa ennakoivan ja huomioivan tällaisia olosuhteissa tapahtuvia muutoksia tarjousta tehdessään.

Tämän muutoksen tarkoitus on varmistaa heliumin riittävyys välttämättömiin kohteisiin. Vastaava rajoitus tehdään väliaikaisesti sopimustoimittajan kaikille asiakkaille

Suomessa pl. etusijalla olevat terveydenhuollon asiakkaat. Lisäksi tarkoituksena on mahdollistaa puitesopimuksen jatkaminen ennalta-arvaamattomista saatavuushäiriöistä

huolimatta.
