Support to Deployment, Maintenance and Operations

Place of performance will focus on EUSPA HQ, Prague, Galileo Control Centres in Oberpfaffenhofen and Fucino, EUSPA site in Toulouse and the contractor"s premises, with missions across Europe.

This specific contract implements Framework Contract (FWC) No GSA/OP/05/20/Lot 8 – ‘Support to Deployment, Maintenance and Operations’, signed by the contracting authority and the contractor on 21 October 2021. The subject matter of lot 8 may include Space Segment maintenance support, European space programmes service preparation, service provision and operations support, EGNOS export and international developments, Ground Segment maintenance and deployment support, space programmes telecommunication network support, and site infrastructure hosting support for European space programmes.

Within 2 months of the notification of the modification to the contract, an appeal may be lodged to the review body in heading VI.4.1. You may submit any observations concerning the modification to the contract to the contracting authority indicated in heading I.1. If you believe that there was maladministration, you may lodge a complaint to the European Ombudsman within 2 years of the date when you became aware of the facts on which the complaint is based (see http://www.ombudsman.europa.eu). Such complaint does not have as an effect either to suspend the time-limit to launch an appeal or to open a new period for lodging an appeal.

This specific contract implements Framework Contract GSA/OP/05/20/Lot8 – ‘Support to Deployment, Maintenance and Operations’, signed by the contracting authority and the contractor on 21 October 2022. The subject matter of this lot may include Space Segment maintenance support, European space programmes service preparation, service provision and operations support, EGNOS export and international developments, Ground Segment maintenance and deployment support, space programmes telecommunication network support, and site infrastructure hosting support for European space programmes.

— Art 2.1: Extension of the validity of SC2 to 31 October 2023;

— Art 3.1: Increase in price from EUR 3 935 330,00 to EUR 4 774 356,00;

— Art 4.1: Modification of the Payment Schedule of Article 4.1 and of Annexes SC.I and SC.II of SC2, according to the contractor"s updated offer.

The value of the modifications to the specific contract does not exceed 50 % of the initial SC value. The modifications were brought by circumstances that a diligent contracting authority could not foresee. In particular, the extension of the validity of the SC until 31 October 2023, and the resulting price increase, was necessary for the proper allocation of resources to the new (follow-up) specific contract, in view of the need to ensure synergies of the resources allocated to the current and upcoming tasks of the Agency, which were to be assigned to EUSPA via Contribution Agreements on IRIS2, SST and Copernicus Security (CAs). As at the time of the specific contract expiry these CAs were at a stage of finalisation, the present specific contract was extended so that the new specific contract could cover also the new CAs tasks in an optimised/synergised manner. The amendment is in line with Article 172(2) and 172(3)(b) FR (Regulation (EU, Euratom) No 1046/2018 as amended).
