        Dynamic purchasing system of collection of chemical compounds for automated chemical libraries for the Palacký University Olomouc (2023-2026)

        The subject of public contracts in DPS will be groups of chemical substances in a suitable format for use in automated chemical libraries under the commercial and technical conditions specified by the Contracting Authority. This is a collection of chemical compounds that are either synthetic or derived from natural sources (nutraceuticals, phytochemicals) that will be stored in tubes or microtiter plates that have unique identifiers for easy tracking and retrieval. Each compound will be defined by a specific chemical structure, form (e.g. powder, solution with defined solvent) and purity level that is confirmed by the analytical data provided. Analytical data may include high performance liquid chromatography (HPLC) and/or high resolution mass spectrometry (HRMS) and/or nuclear magnetic resonance (NMR) spectroscopy, which are techniques that can separate, identify and quantify chemical entities. The subject matter is intended for use for research and development purposes in the fields of biotechnology and medicine.

        The subject matter of specific public contracts awarded under the DPS will always be specified in the invitation to tender within the meaning of Section 141 of the Act.

        The place of delivery of individual public contracts is Palacký University in Olomouc (Olomouc, Czech Republic), its individual departments. The exact address of the place of delivery will be specified by the Contracting Authority in the individual public contracts awarded under the DPS.

      4. Description of the procurement:

        The DPS shall be implemented for a period of 36 months.

        The Contracting Authority envisages the award of public contracts in the DPS at irregular intervals not determined in advance, depending mainly on the operational needs of the Contracting Authority. Also, the volume of individual procurement contracts awarded in the DPS is expected by the Contracting Authority to range from units to tens of units in a specific procurement and cannot be predicted with certainty. Since the basic principle of public procurement is the efficient use of public funds and one of the sub-objectives is to achieve the lowest price, the expected volumes cannot be determined more precisely or financially.

        Precise information on deadline(s) for review procedures:

        The filing of objections with the Contracting Authority is a condition for filing a proposal with The Office for the Protection of Competition, which must be delivered within 15 days from the date on which the complainant became aware of the alleged violation of the law by the Contracting Authority, but no later than the conclusion of the contract.

        Objections to actions notified in documents that the Contracting Authority is required by law to publish or send to the complainant must be received by the Contracting Authority within 15 days of their publication or delivery to the complainant.

        Where a time limit for the submission of requests to participate is set in the procurement procedure, objections to conditions relating to the supplier"s qualification must be received by the Contracting Authority no later than the end of that time limit.

        Where the procurement procedure sets a time limit for the submission of tenders, any objections to the procurement documentation must be received by the Contracting Authority no later than the end of that time limit.

        The Contracting Authority is obliged to deal with the objections within 15 days. The application must be delivered to the Office and the Contracting Authority within 10 days from the date on which the complainant received the decision by which the Contracting Authority rejected the objections or within 25 days from the dispatch of the objections if the Contracting Authority has not decided on the objections.

        After the conclusion of a public contract, only the imposition of a ban on the performance of the contract may be made, even without prior filing of objections. The petitioner shall deliver the proposal to impose a prohibition on the performance of the contract pursuant to Section 254(1)(d) of the Act to the Office and in a counterpart to the Contracting Authority within 1 month from the date on which the Contracting Authority published a notice on the conclusion of a contract in a dynamic purchasing system pursuant to Section 142 of the Act, but no later than 6 months from the conclusion of this contract.

        Within the time limit for delivery of the proposal, the proposer is obliged to deposit a security deposit in the amount of 1% of the proposer"s tender price for the entire period of performance of the public contract or for the first four years of performance in the case of contracts for an indefinite period, but at least CZK 50,000 and no more than CZK 10,000,000. In the event that the proposer is unable to determine the total tender price, he shall be required to lodge a security deposit of CZK 100 000. In the event of an application for a ban on the performance of the contract, the applicant shall be required to lodge a security deposit of CZK 200 000.
