         Na temelju članka 266. stavka 1. Zakona, ponuditelj, član zajednice, podugovaratelj ili drugi subjekt moraju u ovom postupku javne nabave dokazati sposobnost za obavljanje profesionalne djelatnosti upisom u odgovarajući registar što se dokazuje izvatkom iz sudskog, obrtnog, strukovnog ili drugog odgovarajućeg registra koji se vodi u državi članici poslovnog nastana gospodarskog subjekta.

         Naručitelj će ovaj dokaz zahtijevati od ekonomski najpovoljnijeg ponuditelja, člana zajednice, podugovaratelja ili drugih subjekata na čiju sposobnost se ponuditelj oslanja u fazi pregleda i ocjene ponuda, u obliku APD-a, osim ako će tom dokumentu imati izravan pristup elektroničkim sredstvima komunikacije putem besplatne nacionalne baze podataka ili putem EOJN ili ako već ne posjeduje te dokumente. Sukladno čl.20.st.10.Pravilnika, smatra se da su dokumenti iz članka 265.st.1.t.2. i 3. i stavka 2.ZJN ažurirani ako nisu stariji od dana početka postupka javne nabave
