        List and brief description of conditions:

        Gospodarski subjekt mora dokazati upis u sudski, obrtni, strukovni ili drugi odgovarajući registar u državi njegova poslovnog nastana.

        Za potrebe utvrđivanja gore navedenog, gospodarski subjekt u ponudi dostavlja:

        - ispunjeni eESPD obrazac u kojem mora biti popunjeno: ispunjeni eESPD obrazac u dijelu IV. Kriteriji za odabir gospodarskog subjekta, Odjeljak A: Sposobnost za obavljanje profesionalne djelatnosti, za sve gospodarske subjekte u ponudi.

        Naručitelj će prije donošenja odluke o odabiru od ponuditelja koji je dostavio ekonomski najpovoljniju ponudu zatražiti da u primjerenom roku, ne kraćem od 5 (pet) dana, dostavi ažurirane popratne dokumente kojim dokazuje uvjete sposobnosti, osim ako već posjeduje te dokumente:

        - izvadak iz sudskog, obrtnog ili drugog odgovarajućeg registra koji se vodi u državi njegova poslovnog nastana.

        Sukladno članku 20. stavku 2. Pravilnika o dokumentaciji o nabavi te ponudi u postupcima javne nabave (NN 65/17, 75/20), ažurirani popratni dokument je svaki dokument u kojem su sadržani podaci važeći, odgovaraju stvarnom činjeničnom stanju u trenutku dostave naručitelju te dokazuju ono što je gospodarski subjekt naveo u eESPD-u.

        Sukladno članku 20. stavak 3. Pravilnika o dokumentaciji o nabavi te ponudi u postupcima javne nabave (NN 65/17, 75/20), smatra se da naručitelj posjeduje ažurirane popratne dokumente ako istima ima izravan pristup elektroničkim sredstvima komunikacije putem besplatne nacionalne baze podataka na jeziku iz članka 280. stavka 2. ZJN 2016/2022 ili putem EOJN RH.

        Za rješavanje o žalbama nadležna je Državna komisija za kontrolu postupaka javne nabave.

        Žalbeni postupak vodi se prema odredbama ZJN 2016/2022. i Zakona o općem upravnom postupku i temelji se na načelima javne nabave i upravnog postupka.

        Pravo na žalbu ima svaki gospodarski subjekt koji ima ili je imao pravni interes za dobivanje određenog ugovora o javnoj nabavi i koji je pretrpio ili bi mogao pretrpjeti štetu od navodnoga kršenja subjektivnih prava.

        Pravo na žalbu ima i središnje tijelo državne uprave nadležno za politiku javne nabave i nadležno državno odvjetništvo.

        Žalba se izjavljuje Državnoj komisiji u pisanom obliku. Žalba se dostavlja elektroničkim sredstvima komunikacije putem međusobno povezanih informacijskih sustava Državne komisije i EOJN RH (u daljnjem tekstu: sustav e-Žalba). EOJN RH se smatra poslužiteljem za potrebe sustava e-Žalba.

        Žalitelj je obvezan primjerak žalbe dostaviti naručitelju u roku za žalbu.

        U otvorenom postupku žalba se izjavljuje u roku od 10 dana, i to od dana:

        • objave poziva na nadmetanje, u odnosu na sadržaj poziva ili dokumentacije o nabavi,

        • objave obavijesti o ispravku, u odnosu na sadržaj ispravka,

        • objave izmjene dokumentacije o nabavi, u odnosu na sadržaj izmjene dokumentacije,

        • otvaranja ponuda u odnosu na propuštanje naručitelja da valjano odgovori na pravodobno dostavljen zahtjev dodatne informacije, objašnjenja ili izmjene dokumentacije o nabavi te na postupak otvaranja ponuda,

        • primitka odluke o odabiru ili poništenju, u odnosu na postupak pregleda, ocjene i odabira ponuda, ili razloge poništenja.

        Žalitelj koji je propustio izjaviti žalbu u određenoj fazi otvorenog postupka javne nabave sukladno

        gore navedenim opcijama nema pravo na žalbu u kasnijoj fazi postupka za prethodnu fazu.

        Žalba mora sadržavati najmanje podatke i dokaze navedene u članku 420. ZJN 2016/2022.

        Za rješavanje o žalbama nadležna je Državna komisija za kontrolu postupaka javne nabave.

        Žalbeni postupak vodi se prema odredbama ZJN 2016/2022. i Zakona o općem upravnom postupku i temelji se na načelima javne nabave i upravnog postupka.

        Pravo na žalbu ima svaki gospodarski subjekt koji ima ili je imao pravni interes za dobivanje određenog ugovora o javnoj nabavi i koji je pretrpio ili bi mogao pretrpjeti štetu od navodnoga kršenja subjektivnih prava.

        Pravo na žalbu ima i središnje tijelo državne uprave nadležno za politiku javne nabave i nadležno državno odvjetništvo.

        Žalba se izjavljuje Državnoj komisiji u pisanom obliku. Žalba se dostavlja elektroničkim sredstvima komunikacije putem međusobno povezanih informacijskih sustava Državne komisije i EOJN RH (u daljnjem tekstu: sustav e-Žalba). EOJN RH se smatra poslužiteljem za potrebe sustava e-Žalba.

        Žalitelj je obvezan primjerak žalbe dostaviti naručitelju u roku za žalbu.

        • otvaranja ponuda u odnosu na propuštanje naručitelja da valjano odgovori na pravodobno dostavljen zahtjev dodatne informacije, objašnjenja ili izmjene dokumentacije o nabavi te na postupak otvaranja ponuda,

        • primitka odluke o odabiru ili poništenju, u odnosu na postupak pregleda, ocjene i odabira ponuda, ili razloge poništenja.

        Žalitelj koji je propustio izjaviti žalbu u određenoj fazi otvorenog postupka javne nabave sukladno

        gore navedenim opcijama nema pravo na žalbu u kasnijoj fazi postupka za prethodnu fazu.

        Žalba mora sadržavati najmanje podatke i dokaze navedene u članku 420. ZJN 2016/2022.
