Tijekom izvršenja Osnovnoga ugovora i 1. Dodatka ugovoru, pojavila se potreba za izvođenjem dodatnih, nepredviđenih radova koji nisu obuhvaćeni 1. Dodatkom ugovoru.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive
2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
Zbog nepovoljnih vremenskih prilika nije bilo moguće izvoditi pojedine vrste
radova. U građevinskom dnevniku su evidentirani dani kada vremenski uvjeti
(visoke temperature i kišna vremena) nisu dozvoljavali bilo kakav vanjski rad na objektu.
Ugovoreni radovi su kasnili zbog događaja ili okolnosti na tržištu koji su u potpunosti
izvana Izvođačeve kontrole i odgovornosti. S obzirom na gore navedene razloge
možemo smatrati „višom silom“ na koje izvođač nije mogao nikako utjecati.
