        Gospodarski subjekt mora dokazati upis u sudski, obrtni, strukovni ili drugi odgovarajući registar u državi njegova poslovnog nastana.

        Za potrebe utvrđivanja gore navedenog, gospodarski subjekt u zahtjevu za sudjelovanje dostavlja:

        - ispunjeni ESPD obrazac (Dio IV. Kriteriji za odabir, odjeljak ? za ponuditelja i člana zajednice gospodarskih subjekata)U slučaju zajednice gospodarskih subjekata svi članovi obvezni su pojedinačno dokazati ovu sposobnost.

        Naručitelj će u drugom stupnju, prije donošenja odluke o odabiru od ponuditelja koji je dostavio ekonomski najpovoljniju ponudu zatražiti da u primjerenom roku, ne kraćem od 5 (pet) dana, dostavi ažurirane popratne dokumente kojim dokazuje uvjete sposobnosti, osim ako već posjeduje te dokumente:
