3、Qualification Requirements For Bidder
Qualifications or Performance:3.1.1 A bidder shall be an independent legal entity or other organization in compliance with the Bidding and Tendering Law of the People"s Republic of China. Domestic bidders shall provide a business license or legal person certificate; overseas bidders shall submit local registration documents.
3.1.2 The original or copy of a credit certificate issued by the bidder"s depository bank within three months prior to the bid opening date.
3.1.3 The bidder shall undertake that the export of its equipment and software fully complies with applicable international and Chinese laws and regulations, and shall assist in completing all necessary import and export licensing procedures.
3.1.4 For domestic products of this project, only bids from manufacturers are acceptable. For overseas products, bids from both manufacturers and authorized agents are allowed. If the bidder is an agent for the tendered products, it shall obtain and submit a valid authorization letter issued by the product manufacturer. The manufacturer and its agent shall not participate in the bidding simultaneously.
Suppliers outside China"s customs territory shall quote on DAP terms only; suppliers within China"s customs territory shall quote on DDP terms only. Where an overseas supplier intends to bid through an agent, the agent shall also be an overseas entity and quote exclusively on DAP terms. Bidders supplying goods and services from outside China"s customs territory shall be capable of signing foreign trade contracts directly with the tenderer or its designated foreign trade agent.
3.1.5 Consortium bids are not accepted for this project.
3.1.6 If awarded the bid, the successful bidder shall sign a written contract in accordance with the tender documents and its bid proposal, and shall not add any unreasonable clauses or impose extra requirements on the tenderer.
3.1.7 Within the past year, neither the bidder nor the manufacturer of the tendered products has any major illegal records in business activities, has never won bids by unfair competition means, nor been involved in major economic criminal cases. Neither party has had contracts terminated or lost lawsuits as the defendant due to breach of contract, illegal acts or violation of business ethics.
3.1.8 Performance Requirements The supplier shall provide sales records proving that the manufacturer has sold no less than 15 units of original equipment of the same brand and model worldwide from January 1, 2023 to the present (counted by the contract signing date). The documents shall specify the sales date, corresponding customer name (customer codes are acceptable) and quantity of each order.
During the bidding period, the bidder shall submit key pages of purchase orders, sales contracts or user acceptance certificates. A commitment stating "All information provided is true and authentic. We shall bear corresponding legal liabilities if any information is inconsistent with facts" shall be attached, duly signed by the authorized representative and affixed with the company"s official seal. The tenderer reserves the right to inspect the original performance documents when necessary. In addition, the bidder shall submit a letter of commitment on the authenticity of performance in the format specified in the tender documents.
3.1.9 The bidder shall submit an enterprise profile form, which may include detailed nature of the entity, registration information, business scope, copies of relevant industrial qualification certificates and other supporting documents to prove its qualification for this bidding. All documents shall be affixed with the official seal to guarantee the truthfulness and accuracy of the information.
