3、Qualification Requirements For Bidder
Qualifications or Performance:3.1.1
The Bidder shall be an independent legal entity or other organization in compliance with the Bidding Law of the People"s Republic of China. Domestic Bidders shall submit a Business License or Legal Person Certificate; overseas Bidders shall submit their local registration documents.
3.1.2
Original or certified copy of a bank credit certificate issued by the Bidder"s depository bank within three months prior to the bid opening date.
3.1.3
The Bidder shall undertake that the export of its equipment and software fully complies with applicable international and Chinese laws and regulations, and shall assist in completing all necessary import and export approval formalities.
3.1.4
Only bids from original equipment manufacturers will be accepted for domestically manufactured products under this Project. For overseas-sourced products, bids from either manufacturers or authorized agents are acceptable. Where the Bidder is an authorized agent, a valid authorization letter issued by the relevant equipment manufacturer must be submitted; the manufacturer and its authorized agent are prohibited from participating in the same tender simultaneously.Suppliers outside China"s customs territory shall quote exclusively on a DAP basis; suppliers within China"s customs territory shall quote exclusively on a DDP basis. If an overseas supplier intends to bid via an agent, such agent shall be an enterprise registered outside China"s customs territory and shall only quote on DAP terms.
3.1.5
Bidders supplying goods and services from outside China"s customs territory must have the capability to sign foreign trade contracts directly with the Tenderer or its designated authorized foreign trade agent.
3.1.6
Consortium bidding is not permitted for this tender.
3.1.7
Upon winning the tender, the successful Bidder shall execute a written contract strictly in accordance with the tender documents and its submitted bid documents, and shall not add any unreasonable supplementary clauses or impose extra requirements on the Tenderer.
3.1.8
Neither the Bidder nor the manufacturer of the tendered equipment has any record of serious illegal business activities in the most recent one year, including fraudulent bid winning through improper competition, involvement in major economic criminal cases, contract termination due to the Bidder"s own breach of contract, illegal conduct or breach of business ethics, or adverse court rulings as a defendant. A self-drafted commitment letter covering the above content shall be submitted.
3.1.9 ① Sales Performance Requirements
The Bidder shall provide sales records proving that the identical-brand, same-type original equipment has achieved global cumulative sales of no less than [15] units from January 1, 2023 to the contract signing date. Submission shall specify sales date, end-user name (which may be replaced by coded identifiers) and quantity per order.Key pages of purchase orders, sales contracts or customer acceptance certificates shall be furnished during the bidding phase. Supporting documents must be attached with a written undertaking reading: "All information herein is true and accurate; the Bidder shall bear corresponding legal liabilities for any false information", duly signed by the authorized representative and affixed with the Bidder"s official company seal. The Tenderer reserves the right to inspect original performance certificates at any time as needed. In addition to the aforesaid documents, the Bidder shall submit a performance authenticity commitment letter in the format specified in the tender file.
3.1.10 ② Process Qualification Documents
The Bidder shall provide ball mounting process acceptance documents for substrates with single-piece dimension no less than 10mm×10mm, together with end-user acceptance certificates specifying full process details (including but not limited to process specifications and acceptance criteria defined in Clause 5.4 of the technical specification).
3.1.11
The Bidder shall submit a corporate profile form containing detailed enterprise type, registration particulars, business scope, copies of relevant industrial qualification certificates and other supporting documents verifying the Bidder"s capacity to fulfill the tender obligation. All materials shall bear the Bidder"s official seal to confirm the truthfulness and accuracy of all contents.
