3、Qualification Requirements For Bidder
Qualifications or Performance:3.1.1
The Bidder shall be an independent legal person or other organization complying with the Bidding Law of the People"s Republic of China. Domestic Bidders shall submit their business license or legal person certificate; overseas Bidders shall submit their local registration documents.
3.1.2
Original or duplicate copy of a credit certificate issued by the Bidder"s depository bank within three (3) months prior to the bid opening date.
3.1.3
The Bidder shall warrant that the export of its equipment and software fully complies with applicable international and Chinese laws and regulations, and shall assist in completing all necessary import and export licensing formalities.
3.1.4
For domestic products under this Project, only bids submitted by product manufacturers shall be accepted. For overseas products, bids from either manufacturers or authorized agents are acceptable. Where the Bidder is an authorized agent of the tendered products, a valid authorization letter issued by the original equipment manufacturer shall be furnished; the manufacturer and its authorized agent shall not participate in the same bidding simultaneously.Suppliers located outside China"s customs territory shall quote on a DAP basis only; suppliers within China"s customs territory shall quote on a DDP basis only. Where an overseas supplier intends to tender via an agent, such agent shall be an enterprise registered outside China"s customs territory and shall quote exclusively on a DAP basis.Bidders supplying goods and services from outside China"s customs territory shall possess the capacity to directly execute foreign trade contracts with the Tenderer or its appointed authorized foreign trade agent.
3.1.5
Joint venture consortia are not acceptable for this tender.
3.1.6
Upon being awarded the Contract, the successful Bidder shall enter into a written contract in accordance with the tender document and the successful bidder"s bid proposal; no unreasonable supplementary clauses or extra requirements against the Tenderer shall be added.
3.1.7
Neither the Bidder nor the manufacturer of the tendered goods has any record of serious illegal business activities over the past year, including winning bids via unfair competition, being involved in major economic criminal cases, or having contracts terminated or losing litigations as a respondent due to its own breach of contract, illegal acts or violations of business ethics.
3.1.8
The Supplier shall provide sales performance evidencing that the original-brand, 8-inch equipment of identical model has achieved a global cumulative sales volume of no less than [10] units from January 1, 2023 up to the date of contract signing. Submission shall specify equipment delivery date, end-user name (which may be marked by coded designation) and order quantity per transaction.During bidding, key pages of purchase orders, sales contracts or end-user acceptance certificates shall be attached. A signed commitment stating "All information provided herein is true and authentic; the Bidder shall bear corresponding legal liabilities for any falsification" with signature of authorized representative and official corporate seal of the Bidder shall be appended to the supporting documents. The Tenderer reserves the right to inspect original performance certificates whenever necessary. In addition to the aforesaid supporting papers, the Bidder shall submit a written letter of authenticity commitment in the format specified in the tender document.
3.1.9
The Bidder shall fill out and submit a corporate profile sheet detailing enterprise nature, registration particulars, business scope, relevant industrial qualification certificates (duplicate copies attached) and other supporting documentation demonstrating the Bidder"s capability to perform the tender obligation. All documents shall be affixed with the Bidder"s official corporate seal to certify truthfulness and accuracy of all information.
3.1.10
To verify compliance with all aforementioned qualification criteria, the Bidder shall submit all required supporting documents within its bid package as specified.
