3、Qualification Requirements For Bidder
Qualifications or Performance:1) The bidder shall be an independent legal person or other organization that complies with the provisions of the "Bidding and Tendering Law of the People"s Republic of China" (domestic bidders shall provide a business license or legal person certificate, while foreign bidders shall provide local registration documents);
2) The original or photocopy of the credit certificate issued by the bidder"s bank within three months prior to the bid opening date;
3) The bidder must commit to ensuring that the export of its equipment and software fully complies with relevant international and Chinese laws and regulations, and assist in handling all necessary import and export licensing procedures. (Provide a written statement in the format of Appendix 6-7.)
4) For domestic products, this project only accepts bids from product manufacturers. For foreign products, bids are accepted from both product manufacturers and agents. If the bidder is an agent of the product, a valid authorization letter issued by the manufacturer of the goods must be obtained and provided. The manufacturer and agent cannot participate in the bidding simultaneously. (Refer to Appendix 6-5 for the authorization letter issued by the manufacturer.)
5) Suppliers outside the customs territory can only quote in DAP terms, while those within the customs territory must use DDP terms. If suppliers outside the customs territory require an agency company to bid, the agency must be a company outside the customs territory and can only quote in DAP terms. Bidders providing goods and services from outside China"s customs territory must possess the capability to directly sign foreign trade contracts with the tendering party or its entrusted foreign trade agency.
6) If the bidder wins the bid, a written contract must be concluded in accordance with the bidding documents and the winning bidder"s bid documents, without adding any other unreasonable clauses or imposing additional requirements on the tendering party. (Provide a written statement in the format specified in Appendix 6-7.)
7) The bidder and the manufacturers of the bidding goods have no major illegal records in their business activities within the past year, have not used unfair competition methods to win bids, have no major economic or criminal cases, and have not caused contract termination or been adjudicated as defendants due to any breaches, violations of laws, or breaches of commercial ethics; (Provide a written statement in the format specified in Attachment 6-7.)
8) The bidding equipment provided by the bidder shall be a brand-new product. (Submit a written declaration in the format specified in Attachment 6-7.)
9) Performance Requirement: The supplier must provide sales performance data for original factory equipment of the same brand and model, with a global market sales volume of ≥[5] units from January 1, 2023, to the present (based on the contract signing date). The data must include the equipment sales date, corresponding customer names (customer names may be replaced with codes), and the number of orders. During the bidding phase, procurement orders, procurement contracts, or user acceptance certificates must be submitted, including the key information pages. The submitted materials must include a statement confirming the accuracy of the provided information, with a commitment that "if the information does not match the actual situation, the supplier shall bear legal responsibility," signed by an authorized representative and stamped with the bidder"s official seal. The tendering party reserves the right to verify the original sales performance documentation when necessary. (In addition to the above supporting documents, the bidder must also provide a letter of commitment on the authenticity of the performance in the format specified in Appendix 6-9 of the tender documents.) Note: This performance figure shall not include demo units or POs for undelivered equipment.
