3、Qualification Requirements For Bidder
Qualifications or Performance:1) The bidder shall be an independent legal person or other organization that complies with the provisions of the Tendering and Bidding Law of the People"s Republic of China (domestic bidders shall provide a business license or legal person certificate, and overseas bidders shall provide local registration documents);
2) Original or photocopy of the credit certificate issued by the bidder"s bank within three months prior to the bid opening date;
3) The bidder shall promise that its equipment and software exports fully comply with relevant international and Chinese laws and regulations, and assist in handling all necessary import and export license procedures (provide a written statement in the format of Annex 6-7);
4) This project only accepts bids from domestic product manufacturers. For overseas products, we accept bids from both product manufacturers and agents. If the bidder is the agent of the product being bid on, they must obtain and provide a valid authorization letter issued by the manufacturer of the selected goods. The original factory and the agent cannot participate in the bidding at the same time (according to the authorization letter issued by the manufacturer in Annex 6-5).
5) Suppliers outside the customs can only quote with DAP, while suppliers within the customs can only quote with DDP. If a supplier from outside the country needs an agent company to bid, the agent company must be an outside the country company and can only quote with DAP. Bidders providing goods and services from outside the Chinese customs must have the ability to directly sign foreign trade contracts with the tenderer or its authorized foreign trade agency.
6) If the bidder wins the bid, they must enter into a written contract in accordance with the bidding documents and the winning bidder"s bidding documents, and shall not add any other unreasonable terms or additional requirements to the tenderer (provide a written statement in the format of Annex 6-7);
7) The bidder and the manufacturer of the bidding goods have no significant illegal records in their business activities within the past year, no use of unfair competition to obtain the bid, no major economic or criminal cases, and no termination of the contract or failure as a defendant due to any breach of contract, illegal or unethical behavior (provide a written statement in the format of Annex 6-7);
8) The bidding equipment provided by the bidder should be brand new products from the country of origin (provide a written statement in the format of Annex 6-7).
9) Performance requirements: The supplier must provide sales performance of original equipment of the same brand and type with a market sales volume of ≥ [100] units from January 1, 2023 to the present (based on the contract signing time), and indicate the equipment sales time, corresponding customer name (customer name can be described with a code), and order quantity. During the bidding phase, it is necessary to provide materials such as purchase orders, purchase contracts, or user acceptance certificates, including key information pages. In the provided materials, it is necessary to attach a relevant commitment stating that "the above information is true and reliable, and if it does not match the actual situation, we are willing to bear legal responsibility", and to authorize a representative to sign and affix the bidder"s company seal. If necessary, the tenderer reserves the right to inspect the original sales performance certification materials. (In addition to the above-mentioned proof materials, bidders must provide a commitment letter of performance authenticity in accordance with the format of the bidding documents.)
