3、Qualification Requirements For Bidder
Qualifications or Performance:Any legal person or other organization from the People"s Republic of China or a country or region that has normal trade relations with the People"s Republic of China that meets the following conditions, in addition to meeting the requirements for qualified bidders as stated in Article 2.2 of Chapter 1 of the 2014 edition of the "International Competitive Bidding Documents for Procurement of Mechanical and Electrical Products" prepared by the Department of Mechanical and Electrical Industry of the Ministry of Commerce of the People"s Republic of China, shall also meet the following conditions:
(1) Manufacturers can participate in bidding independently, and manufacturers within the customs territory must have a valid business license; Manufacturers outside the customs territory must be legally registered in the country where they are located.
(2) The national general agent or regional agent of the bidding product, or the agent listed in the medical device registration certificate or registration form (hereinafter referred to as the agent), may also participate in the bidding. The national general agent or regional agent shall have an agency certificate and be within the validity period.
(3) Distributors (or agents) authorized by manufacturers, national general agents, regional agents or agents may also participate in the bidding.
(4) Distributors (or agents) within the customs territory, as well as authorized national general agents or regional agents or agents, must have valid business licenses and medical device operation qualification certificates (the business scope in the qualification certificate should cover the types of products being invested. If the invested products belong to Class III, the medical device operation enterprise license shall prevail; if the invested products belong to Class II, the medical device operation enterprise registration certificate or the Class II medical device operation registration information recorded in the system shall prevail); Distributors (or agents) outside the customs territory must be legally registered and authorized by the manufacturer in the local area. If it is Class II or III domestically produced equipment, a manufacturer"s production license is required.
(5) If the goods being tendered (equipment listed in the bidding product list (main equipment) in Chapter 5, Item 2) belong to Class II or III medical device products, a medical device registration certificate is required. If they belong to Class I medical device products, a product filing registration certificate is required.
(6) Having a good business reputation and a sound financial accounting system. (Provide a commitment letter and affix the company seal)
(7) Having a good record of paying taxes and social security funds in accordance with the law. (Provide a commitment letter and affix the company seal)
(8) Having the necessary equipment and professional technical capabilities to fulfill the contract. (Provide a commitment letter and affix the company seal)
(9) Provide a declaration letter stating that there have been no significant illegal records in business activities within the three years prior to participating in government procurement activities.
(10) Provide a statement letter stating that there is no record of environmental administrative penalties in business activities within the three years prior to participating in government procurement activities.
(11) If the bidder is a domestic enterprise, they must also meet the following conditions: they must be a bidder who is not listed as a "dishonest debtor" or a "major tax illegal dishonest subject" on the Credit China website (www.creditchina. gov.cn), or on the "Government Procurement Serious Illegal Dishonest Behavior Record List" on the China Government Procurement Network (www.ccgp. gov.cn).
