3、Qualification Requirements For Bidder
Qualifications or Performance:Qualifications or performance that bidders should possess: Any legal person or other organization from the People"s Republic of China or from a country or region that has normal trade relations with the People"s Republic of China and meets the following conditions, In addition to meeting the requirements for qualified bidders as stipulated in Clause 2.2 of Chapter 1 "Instructions to Bidders" of Volume 1 of the "International Competitive Bidding Documents for Procurement of Mechanical and Electrical Products" compiled by the Department of Machinery and Electronics and Science and Technology Industry of the Ministry of Commerce of the People"s Republic of China in the 2014 edition, the following conditions should also be met:
3.1 Manufacturers can independently participate in the bidding. Manufacturers within the territory of the country must have valid business licenses. Manufacturers outside the customs territory must be legally registered in their home country.
3.2 The national general agent or regional agent of the bidding products, or the agent listed in the medical device registration certificate or registration form (hereinafter referred to as the "agent") may also participate in the bidding. The national general agent or regional agent shall have an agency certificate and it shall be within the validity period.
3.3 Dealers (or agents) authorized by the manufacturer or the national general agent or regional agent or agent may also participate in the bidding.
3.4 Domestic distributors (or agents) and the national general agents or regional agents or agents authorized to them must have valid business licenses and medical device operation qualification certificates (the business scope in the operation qualification certificate should cover the category of the products being tendered. If the products being tendered belong to Class III, the medical device operation license shall prevail; if the products being tendered belong to Class II, (Based on the medical device business filing certificate); Dealers (or agents) outside the country must be legally registered and authorized by the manufacturer in the local area.
3.5 The bidding products must obtain the Medical Device Registration Certificate (applicable to Class II and Class III).
3.6 If the bidder is a domestic enterprise, it must also meet the following conditions: The bidder must not be listed as a "dishonest executive" or "tax violation blacklist" on the website of Credit China (www.creditchina.gov.cn) or as having a "record of serious illegal and dishonest behaviors in government procurement" on the website of China government procurement (www.ccgp.gov.cn) (provide a commitment letter with the official seal) For a consortium bid, all parties of the consortium must provide).
3.7 Comply with the provisions of Article 22 of the Government Procurement Law of the People"s Republic of China (provide a commitment letter with the official seal; for joint bids, all parties of the joint bid must provide it).
3.8 This project accepts joint bids. Consortium bidding form: (1) Each party of the consortium shall have independent legal person status and sign a consortium agreement, clearly defining the lead party of the consortium and the rights and obligations of each party. The leading unit of the consortium shall be responsible for the registration of this project, submission of response documents and other related matters. (2) For a consortium composed of units of the same profession, the qualification grade shall be determined based on the lower qualification grade of the units. (3) Each party of the consortium shall not bid in its own name alone or join other consortia in this project. (4) The number of consortium members shall not exceed two (inclusive). (5) All parties of the consortium must have independent legal person status, and the entity with a medical device production license or a medical device business license/filing certificate shall serve as the lead party of the consortium.
