Description
The Ministry of Attorney General is responsible for implementing and administrating a process for the provision of Civil Execution Services (CES) by Court Bailiffs appointed under the Sheriff
Act.
Court Bailiffs are legally authorized to enforce court orders from civil proceedings; however they cannot execute any civil or criminal court order which entails the search, apprehension or
arrest of individuals. The Court Bailiffs will provide CES involving the seizure and sale of judgment Debtor’s goods and chattels in order to satisfy a court order issued in civil
proceedings.
The court orders that may be executed are set out in Schedule A (Services) to Appendix A: Contract Form. To satisfy a court order, Court Bailiffs can:
seize and sell judgment Debtor’s goods and chattels;
evict tenants from residential premises and turn over possession to the landlords, and seize/sell sufficient goods and chattels of the dispossessed tenant to satisfy costs; and
sell a specific parcel of land.
The Province is seeking Proponents to become Contractors that will employ individuals to be appointed as Court Bailiffs to provide CES in one or more Service
Area.
The Province requires Contractors to have no less than the Minimum Experience of:
a) at leastone staff person with at least oneyear’s experience, since the end of 2020, executing civil court orders in
British Columbia;
b) a total of at least 3 years experience in the past5 years from the Issue Date of all Proponent’s staff providing CES and/or commercial
bailiff services; and
c) at leastone staff person who is a current Court Bailiff.
Additional proposed Court Bailiffs must have experience in the court or commercial bailiff industries.
The Province’s intent is to enter into Contracts with Proponents who have the highest overall ranking in each Service Area as set out in section 3.3.
