Section III
1. Conditions for participation:
  1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:
    List and brief description of conditions:
    Участниците следва да са вписани от Изпълнителна агенция по лекарствата /ИАЛ/ в един от регистрите по реда на Закона за лекарствените продукти в хуманната медицина /ЗЛПХМ/, даващи им право да извършват търговия на едро с лекарствени продукти на територията на Р. България, а за чуждестранни лица - в аналогични регистри съгласно законодателството на държавата членка, в която са установени /съгласно чл.60, ал.1 от ЗОП/. При сключване на договор с чуждестранно лице, в съответствие с изискванията на чл.112, ал.1, т.4 от ЗОП и изискванията на чл.195 от ЗЛПХМ, определеният за изпълнител участник следва да бъде вписан в регистъра на ИАЛ, даващо му право да извършва търговия на едро с лекарствени продукти на територията на Р.България.

    ДОКАЗВАНЕ: При подаване на офертата участникът декларира съответствие с изискването, като посочва наличието на регистрация в Част IV, раздел А от ЕЕДОП.
    
    При условията на чл. 67, ал. 5 от ЗОП възложителят може да изиска документи, чрез които се доказва декларираната в ЕЕДОП информация - Заверено от участника копие на разрешение, предоставящо право за търговия на едро с лекарствени продукти, издадено от ИАЛ съгласно Закона за лекарствените продукти в хуманната медицина. Такова разрешение може да бъде един от следните документи:
    
    - разрешение/удостоверение за регистрация за търговия на едро с лекарствени продукти, съгласно чл.195, ал.1 от ЗЛПХМ. Ако участникът има складове на територията на Р. България трябва да притежава и разрешение от изпълнителния директор на ИАЛ, съгласно чл.195, ал.2 от ЗЛПХМ;
    
    - разрешение за производство по смисъла на чл.196, ал.1 от ЗЛПХМ;
    
    - разрешение за внос по смисъла на чл.196, ал.2 от ЗЛПХМ;
    
    - друг еквивалентен документ – за участници чуждестранни лица.
