Adaptation des honoraires – 150.000,00 EUR

Considérant que l’estimation des travaux de 5.377.000 EUR HTVA avait été indiquée par l’administration au cahier spécial des charges 2011-CQPPL-001 sur base des éléments connus à ce moment;

Vu la décision du Collège des bourgmestre et échevins du 26 septembre 2019 relative à l’attribution du marché « 2018-T-047 – Ecole ‘De Puzzel’ : construction d’une nouvelle école (site Divercity)» à la société THV BAM Contractors – Galère, Avenue Antoon Van Oss 1 à 1120 Bruxelles, pour le montant d’offre contrôlé et corrigé de 9.862.285,83 EUR HTVA ou 11.499.425,28 EUR, TVA 6% et révision des prix comprises ;

Considérant que le cahier spécial des charges 2011-CQPPL-001 défini au point I.12 les honoraires de l’auteur de projet pour la construction de l’école (tranche conditionnelle) sur base d’un pourcentage liés au montant des travaux ;

Considérant qu’il convient dès lors de procéder à l’adaptation des honoraires d’architecte liée à l’évolution du montant global des travaux de construction conformément au cahier spécial des charges du marché de services 2011-CQPPL-001 sur base de l’offre de l’auteur de projet soit un pourcentage de 11,75% selon le montant des travaux ;

Considérant que l’estimation des honoraires de l’auteur de projet relatif aux travaux de 9.862.285,83 EUR hors TVA ou 11.499.425,28 EUR, TVA 6% et révision des prix comprises s’élève à 1.158.818,58 EUR HTVA, soit à 1.402.170,48 EUR TVA 21% comprise ;

Considérant que le montant d’honoraires déjà engagé s’élève à 926.805,68 EUR HTVA, soit à 1.121.434,87 EUR TVA 21% comprise ;

Considérant que le montant d’honoraires restant s’élève à 332.012,90 EUR HTVA, soit à 401.735,61 EUR TVA 21% comprise ;

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Considérant que ces commandes supplémentaires s’inscrivent dans la perspective de continuité de la MAP pour la construction de l"école De Puzzel et respectent la nature et l’objet du marché initial ;

Considérant que le changement de contractant:

1°est impossible pour des raisons économiques ou techniques telles que l"obligation d"interchangeabilité ou d"interopérabilité des services complémentaires avec les équipements, services ou installations existants achetés dans le cadre du marché initial; et

2°présenterait un inconvénient majeur ou entraînerait une augmentation substantielle des coûts pour l"adjudicateur ;
