3. Section III
   1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:

         Tenzij in het geval waarbij de kandidaat of inschrijver, overeenkomstig artikel 70 van de wet overheidsopdrachten, aantoont toereikende maatregelen te hebben genomen om zijn betrouwbaarheid aan te tonen wordt de kandidaat of inschrijver, in eender welke fase van de procedure, uitgesloten tot deelname aan de procedure indien zij vaststelt dat de kandidaat of inschrijver door een rechterlijke beslissing met kracht van gewijsde veroordeeld is om een van volgende misdrijven:

         1. voor deelname aan criminele organisaties

         2. omkoping

         3. fraude

         4. terroristische misdrijven of strafbare feiten in verband met terroristische activiteiten

         5. medeplichtigheid aan of poging tot het plegen van een dergelijk misdrijf

         Indien de ondernemer niet blijkt te voldoen aan zijn verplichting tot betaling van

         Sociale zekerheidsbijdragen, in welk stadium van de procedure ook, wordt deze uitgesloten van

         deelname aan de plaatsingsprocedure tenzij de bijdrageschuld beantwoordt aan de voorwaarden

         opgenomen in artikel 62, §1 van het KB van 18 april 2017 of de ondernemer kan aantonen dat hij op

         een aanbesteder of op een overheidsbedrijf, één of meer schuldvorderingen bezit die zeker, opeisbaar

         en vrij van elke verbintenis tegenover derden zijn.
