      4. Description of the procurement:
         

         VRT zet in zijn digitale aanbod in op interactie, en biedt daarom binnen zijn digitale touchpoints (onze sites en apps) de mogelijkheid om te chatten (naast andere interactieve toepassingen). VRT maakt momenteel gebruik van een zelf ontwikkelde chat oplossing, die we hebben geïmplementeerd in de apps van enkele van onze radio merken. Deze oplossing voldoet niet meer aan de verwachtingen van VRT en onze eindgebruikers die dagdagelijks via deze chat communiceren met VRT. Bovendien wil VRT “chatten” ook kunnen aanbieden binnen al zijn touchpoints en voor alle merken.

         VRT wenst dit product te vervangen, en hiermee heel wat extra functionaliteiten aan te schaffen om meer gealigneerd te raken met de functionaliteiten van moderne chat oplossingen die vandaag op de internationale markt actief zijn.

   1. Conditions for participation:
      1. Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers:

         * Het UEA, waarmee de ondernemer verklaart dat hij zich niet bevindt in een van de uitsluitingssituaties als bedoeld in de artikelen 67 tot 69 van de wet van 17 juni 2016.

         Artikel 70 van de wet van 17 juni 2016 betreffende de overheidsopdrachten is van toepassing. Voor de in artikel 67 van de wet bedoelde uitsluitingsgronden deelt de gegadigde of inschrijver op eigen initiatief mee of hij bij het begin van de procedure de in artikel 70, lid 1, bedoelde corrigerende maatregelen heeft genomen.

         * Overeenkomstig de Belgische overheidsopdrachtenreglementering heeft de aanbestedende overheid, in elke fase van de gunningsprocedure, de mogelijkheid om de kandidaat/inschrijver uit te sluiten die, bij wijze van een in kracht van gewijsde gegane strafrechtelijke uitspraak veroordeeld werd voor een misdrijf dat zijn professionele integriteit aantast.

         De niet-naleving van strafrechtelijk sanctioneerbare milieu- en sociale wetgeving kan worden geacht een misdrijf te zijn dat de professionele integriteit aantast. Van zodra deze wordt vastgelegd in een in kracht van gewijsde gegaan vonnis of arrest kan deze worden aangewend als uitsluitingsgrond, ongeacht de stand van de procedure.

         Onder sociale wetgeving wordt onder meer verstaan:

         - het decreet van 10 juli 2008 houdende een kader voor het Vlaamse gelijkekansen- en gelijkebehandelingsbeleid; de wet van 10 mei 2007 ter bestrijding van bepaalde vormen van discriminatie, de wet van 10 mei 2007 tot wijziging van de wet van 30 juli 1981 tot bestraffing van bepaalde, door racisme of xenofobie ingegeven daden en de wet van 10 mei 2007 ter bestrijding van discriminatie tussen vrouwen en mannen;

         - de wet van 4 augustus 1996 betreffende het welzijn van de werknemers bij de uitvoering van hun werk, meer bepaald hoofdstuk Vbis. Bijzondere bepalingen betreffende geweld, pesterijen en ongewenst seksueel gedrag op het werk.
